Terms of Service

Last updated: October 2026

Welcome to Frondly LLC. These Terms of Service ("Terms") govern your access to and use of our website, scheduling systems, and professional palm tree trimming and arboricultural services throughout Southwest Florida. By requesting an estimate, booking a service, or using our website, you agree to be bound by these Terms.

1. Services & Estimates

Frondly LLC provides residential and commercial palm tree care, including systematic frond trimming, dead frond removal, storm damage preparation, and canopy pruning.

Estimates provided through our online request form or over the phone are based on client-provided details, property photos, and aerial route data. Final pricing is confirmed prior to the commencement of work if site conditions, palm height, or access obstacles differ substantially from initial submissions.

2. Scheduling, Routes & Cancellations

Clients may choose between fixed appointment dates or flexible proximity scheduling. With flexible scheduling, visits are dispatched when a Frondly LLC crew is operating in your immediate neighborhood, unlocking route-based savings.

We provide arrival windows via SMS and email. If you need to reschedule or cancel a booked service, notice must be provided within our cancellation window.

Rescheduling & Cancellations

24+ Hours Advance Notice: You may cancel or reschedule your service appointment at no charge by providing at least 24 hours' notice prior to your scheduled service window.

Late Cancellations (Under 24 Hours): Cancellations or reschedule requests made within 24 hours of your scheduled service window may be subject to a $50 Late Cancellation Fee.

Same-Day / At-the-Door Cancellations: If our crew arrives at your property during the agreed-upon window and service is canceled at the door or access is blocked, a $75 Trip Charge may apply to cover crew travel and scheduling costs.

South Florida weather can be unpredictable. Safety is our top priority.

Severe Weather: Frondly LLC reserves the right to postpone or reschedule services due to hazardous weather conditions, including severe thunder/lightning, high winds, heavy rain, or tropical storm warnings.

No Fee for Weather Delays: If Frondly LLC must reschedule your service due to dangerous weather, no fees will apply, and our team will contact you to lock in the next available service time on the route.

To modify or cancel your service appointment, please contact us as early as possible: hell@frondly.co or (305) 330-6307.

3. Property Access & Worksite Conditions

Property owners or authorized managers must ensure safe, unobstructed access to palms for our crews, electric lifts, and equipment. Please secure pets, unlock perimeter gates, and remove vehicles or fragile patio items from the designated drop zones prior to crew arrival.

To avoid unnecessary delays or cancellation fees:

Gated Communities: Please notify your gatehouse or provide Frondly LLC with gate access instructions prior to your scheduled day.

Pets & Clear Access: Ensure pets are secured indoors and gated areas leading to trees, palms, or work areas are unlocked.

Obstructions: Clear vehicles, lawn furniture, or outdoor items from under the trees to be serviced.

If our crew cannot safely access the work area upon arrival, we will attempt to reach you immediately. If access cannot be obtained within 15 minutes, the job may be rescheduled and subject to the

4. Payment Terms

Invoices are issued digitally upon completion of work along with before-and-after photo verification. Payment is due upon receipt unless alternative commercial credit terms have been pre-approved. Payment terms:

4.1 Estimates and pricing. Prices are based on the estimate you approve, as described in Section 1. If site conditions, palm height, or access differ materially from what you described, we will tell you and get your approval (by text, email, or signature) before doing additional work or charging more than the approved estimate.

4.2 Deposit or prepayment to reserve your place. We prefer payment in full before service. To reserve your place on our route, we require either:

(a) payment in full in advance; or

(b) a deposit of at least 25% of the estimated price.

Your booking is not confirmed until we receive the prepayment or deposit. For flexible proximity scheduling, the deposit holds your place on the route and does not guarantee a specific date. Optional: Deposits are not required for returning customers with a clean payment history

4.3 How your deposit is used. We apply your deposit to your final invoice. If your deposit is more than the final price, we will refund the difference [or credit it to your account, at your choice] within [10] business days. Deposits are refunded or credited as follows:

We cancel or cannot perform the service (including for weather or safety, as described in Section 2): full refund, or credit if you prefer.

You cancel with 24 hours’ notice or more: full refund .

You cancel with less than 24 hours’ notice: we may keep the Late Cancellation Fee in Section 2 and refund the rest.

Crew arrives and service is cancelled or blocked at the door: we may keep the Trip Charge in Section 2 and refund the rest.

Home solicitation sales: if you signed at your property, your right to cancel and receive a full refund under 24 hours or sale.

We will not keep a deposit as a penalty. Any amount we retain will not exceed the fees stated in Section 2.

4.4 Invoices. We issue a digital itemized invoice when work is complete, with before-and-after photos where available. Invoices list the service, any approved additional work, appiciable taxes and rewards credits or discounts applied, and deposits received.

4.5 Payment methods and due date. We accept checks payable to Frondly LLC, Credit/Debit Card, Cash and ACH. Unless we agree otherwise in writing, the balance is due within 7 days of the invoice date. A payment is considered made when we receive it, not when it is mailed. If you paid in full in advance, you will owe nothing more unless you approved additional work.

If any balance is not paid within [7] days after the due date, we may charge a monthly late fee of  $25 flat fee , applied once per invoice. Late fees are not compounded. Late fees are disclosed here and on your invoice, and are for the cost of late payment, not a penalty for dispute or cancellation.

4.7 Returned checks. If a check is returned unpaid, you agree to pay the amount of the check, any bank fees we actually incur, and the service charge allowed by Florida law. We may also require future payments by certified funds or prepayment, and we may pursue the remedies Florida law provides, including a written demand for payment.

4.8 Past-due accounts. While any invoice is past due, we may pause scheduled or recurring services, require full prepayment for future services, and withhold unused rewards credits from new purchases. If an account is sent for collection, you agree to pay reasonable collection costs. In any legal action about an invoice, the prevailing party may recover reasonable attorneys’ fees and court costs as allowed by Florida law.

4.9 Questions and disputes. If you have a question about an invoice, please contact us within [7] days of receiving it, at hello@frondly.co or (305) 330-6307. You may withhold only the disputed amount, in good faith, while we review it, and must pay the undisputed portion on time. Workmanship concerns follow the Service Guarantee process.

4.10 Who is responsible for payment. The person or entity that books the service is responsible for payment, even if the property is owned by someone else, unless we have agreed in writing to bill a property manager, landlord, or association.

4.11 Refunds. Approved refunds are made by the original payment method, or by check if the original method is unavailable, within [10] business days.

5. Safety & Compliance

Frondly LLC crews operate strictly under safety regulations. Our arborists reserve the right to halt or modify operations in the event of severe weather, lightning, structural hazards, or energized electrical lines.

6. Liability & Property Protection

 We carry comprehensive general liability insurance and is available upon request.

Limitation of Liability

6.1 Our standard of care. Frondly LLC will perform services with reasonable skill and care, consistent with the standards described in our Service Guarantee. Palms and other trees are living things, and arboriculture involves natural variables. We cannot guarantee the health, growth, appearance, or survival of any palm or tree, or how it will respond to trimming, weather, pests, or disease.

6.2 No liability for conditions outside our control. To the extent permitted by law, Frondly LLC is not responsible for loss or damage that results from:

(a) pre-existing conditions of a palm or tree, including disease, pest infestation, rot, structural weakness, nutrient deficiency, or decline that we did not cause;

(b) storms, wind, lightning, flooding, or other weather or natural events, whether before or after our service;

(c) hidden or undisclosed hazards, or inaccurate information provided by you, as described in Section 7; or

(d) work that was changed, repaired, or interfered with by anyone other than Frondly LLC after we completed the service.

6.3 Exclusion of certain damages. To the extent permitted by law, Frondly LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, rental income, business, or use of property, even if we were told such damages were possible.

6.4 Cap on liability. To the extent permitted by law, and except as stated in Section 6.5, Frondly LLC’s total liability to you for all claims arising from a service or from these Terms will not exceed [the amount you paid to Frondly LLC for the service that gave rise to the claim].

6.5 What this Section does not limit. Nothing in these Terms excludes or limits:

(a) liability for gross negligence, recklessness, or willful misconduct, or for fraud;

(b) liability for death or bodily injury caused by Frondly LLC’s negligence;

(c) physical damage to your property caused by our crew or equipment during service, which we will address as described in our Service Guarantee, up to the amount recoverable under our liability insurance; or

(d) any right or remedy you have that cannot be waived or limited under Florida or federal law, including consumer protection laws.

6.6 Prompt notice. To help us investigate while evidence is fresh, please tell us about any problem or damage within [7 days] after the service date, as described in our Service Guarantee. If you report later, we will still consider your claim, but we may not be able to determine the cause, and Section 6.2(d) may apply.

6.7 Website and portals. Our website and the Customer and Vendor Portals are provided on an “as is” and “as available” basis. We do not promise that they will be uninterrupted or error-free, and estimates, route information, and arrival windows are good-faith projections, not guarantees. To the extent permitted by law, Frondly LLC is not liable for losses resulting from website or portal downtime, delays, or errors, apart from our responsibilities under Section 6.5.

6.8 Fairness and relationship to other terms. The limits in this Section reflect a reasonable allocation of risk and are a basis for the pricing of our services. This Section works together with, and does not replace, our Service Guarantee, our Indemnification section, and the liability insurance described in Section 6.

7. Indemnification

7.1 Your responsibilities to us. You agree to defend, indemnify, and hold harmless Frondly LLC, its owners, employees, and crew members from third-party claims, and from the resulting losses, damages, and reasonable costs (including reasonable attorneys’ fees), to the extent they arise from:

(a) inaccurate or misleading information you give us about the property, the palms or trees to be serviced, or their condition, location, or ownership;

(b) your lack of authority to approve work on the property or on the specified palms or trees, including trees that belong to a neighbor, a homeowners’ or condominium association, or a landlord, or that are in a shared or protected area;

(c) hazards on or under the property that you knew about and did not tell us before service, such as buried or hidden irrigation lines, electrical or lighting wiring, septic systems, unmarked fences or structures, aggressive animals, or pest nests; or

(d) your breach of these Terms.

7.2 What this does not cover. You are not responsible under this Section for any claim, loss, or damage to the extent it is caused by the negligence, gross negligence, recklessness, or willful misconduct of Frondly LLC or its crews, or by Frondly LLC’s breach of these Terms. Nothing in this Section limits Frondly LLC’s responsibility to fix workmanship problems under our Service Guarantee or to address property damage that our crew causes.

7.3 Process. If a third party makes a claim that you believe is covered by this Section, or that Frondly LLC believes is covered, the party seeking protection will: (i) give prompt written notice (delay only reduces the other party’s duty to the extent it is harmed by the delay); (ii) allow the other party to control the defense and settlement, provided that no settlement may require the protected party to admit fault or pay money without its written consent, which will not be unreasonably withheld; and (iii) reasonably cooperate at the other party’s expense.

7.4 Frondly LLC’s responsibilities to you. Frondly LLC will defend, indemnify, and hold you harmless from third-party claims, and the resulting losses, damages, and reasonable costs, to the extent they arise from the negligence or willful misconduct of Frondly LLC or its crews while performing services at your property, or from Frondly LLC’s violation of applicable law.

7.5 Relationship to insurance and other rights. This Section works alongside, and does not replace, the liability insurance described in Section 6. It is not a waiver of any rights or protections you have under Florida or federal consumer protection laws.
